The Former Member of Parliament for Gomoa West, Hon. Ebenezer Kojo Abban, has hinted that Hon. Gyakye Quayeson can only be prosecuted when the Attorney General activate criminal proceedings against him.
According to the Former Deputy Minister of Health, the Supreme Court, dealt with the civil aspect of the case brought before it, of which no prison sentence can be made.
Lawyer Abban was responding to questions posed by Kofi Nkoom, on Osimpam Fm’s morning show, “Ghana Ntsi’, as to why the supreme court failed to pronounce judgement on imprisonment of the Assin North MP
The Supreme Court yesterday ruled that, the MP seizes to be one, hence, his name should be expunged from all documents in Parliament, thus, paving way for a by-Election.
Responding to the National Democratic Congress’s statement issued later in the day yesterday, after the Supreme Court’s rulling in the morning, hinting that they will re-present Gyakye Quayeson for the by-election, Lawyer Abban, observed, the party can only do that if no criminal charges are preferred against their candidate.
According to him the law of equity does not allow people to benefit from crimes they commit.
Quoting article 129 clause 4 of the 1992 constitution, he disagreed with the NDC’s claim that the Supreme Court has no jurisdiction to take the MP out of Parliament.
